Mediation provides a structured framework for resolving disputes outside the courtroom. With the assistance of an independent and impartial mediator, parties can explore practical solutions tailored to their legal, financial, commercial, and personal circumstances.
ACMA LAW FIRM offers mediation and alternative dispute resolution services across a broad range of civil, commercial, corporate, real estate, inheritance, and family matters.
Our firm includes accredited mediators who conduct mediation proceedings independently and impartially. Separately, our lawyers represent clients participating in mediation proceedings conducted by other independent mediators.
These roles remain distinct. A mediator does not act as legal counsel to either party in the matter being mediated, while a lawyer representing a client cannot simultaneously serve as the neutral mediator in the same dispute.
Accredited Mediation Services
Our accredited mediators organize and conduct mediation proceedings designed to facilitate constructive discussions between the parties and their legal representatives.
A mediator does not decide the dispute, impose a settlement, or act as a judge. The mediator’s role is to manage the process, encourage effective communication, and help the parties explore whether a mutually acceptable agreement can be reached.
Our mediation services include:
Acting as an accredited independent mediator.
Organizing and managing mediation proceedings.
Communicating with the parties and their legal advisers.
Scheduling joint and, where appropriate, separate sessions.
Facilitating negotiations and the exchange of settlement proposals.
Conducting the process impartially and independently.
Protecting confidentiality in accordance with the applicable rules.
Arranging in-person or remote sessions where legally and practically appropriate.
Preparing the mediation record reflecting the outcome of the proceedings.
Coordinating the formal documentation of any agreement reached by the parties.
Each appointment is assessed with appropriate regard to mediator independence and potential conflicts of interest.
Mandatory Initial Mediation Session
For certain categories of disputes, Greek law requires a mandatory initial mediation session. During this preliminary meeting, the parties receive information about the mediation process and consider whether they wish to continue with mediation.
Our accredited mediators assist with:
Scheduling and conducting the mandatory initial mediation session.
Coordinating communications with the parties and their lawyers.
Explaining the purpose and structure of the mediation process.
Exploring whether the parties wish to proceed with full mediation.
Preparing the relevant mediation records and procedural documentation.
Organizing subsequent sessions if the parties decide to continue.
Participation in the initial session does not require the parties to settle or relinquish their right to seek judicial protection.
Where our firm is not involved in providing the mediator for a particular matter, our lawyers may separately represent a party in proceedings conducted by another independent mediator.
Mediation Records and Settlement Agreements
When the parties reach an agreement, the settlement terms are recorded in the mediation record.
Depending on the dispute, the agreement may address:
Financial obligations and agreed payment amounts.
Installment schedules.
Property handover or use arrangements.
Management of jointly owned assets.
Continuation, amendment, or termination of contractual relationships.
Specific actions required from each party.
Additional notarial, contractual, corporate, or registration formalities.
Other terms necessary for the practical implementation of the settlement.
Subject to the applicable legal requirements and completion of the required formalities, a mediation settlement may acquire the enforceability provided under Greek law.
Legal Representation in Mediation Proceedings
In addition to providing accredited mediator services, ACMA LAW FIRM advises and represents clients participating in mediation proceedings conducted by other independent mediators.
When acting as legal counsel, our lawyers:
Assess the client’s legal position.
Develop an appropriate negotiation strategy.
Review contracts, financial records, and supporting documentation.
Attend mediation sessions as the client’s legal representatives.
Advise on settlement proposals and available alternatives.
Review and negotiate the wording of settlement terms.
Protect the client’s legal and commercial interests.
Coordinate the additional steps required to implement an agreement.
Our role as counsel is always kept separate from the independent and impartial role of the mediator.
