Greek Inheritance Law for Heirs Living Abroad

Inheritance, Wills & Estate Administration in Greece

Administering an estate in Greece can be particularly demanding when heirs reside abroad, the deceased held assets in different locations, or supporting documentation must be obtained from more than one country

ACMA LAW FIRM assists clients with the legal, administrative, tax, and property-related aspects of Greek inheritance matters. We identify the applicable succession framework, investigate the estate, establish the heirs’ rights, and coordinate the steps required to settle and transfer inherited assets.

Our services include:

  • Advising on succession rights and identifying beneficiaries under Greek inheritance law.

  • Investigating the existence of a will and assisting with its publication and related formalities.

  • Preparing and coordinating the acceptance of inheritance.

  • Advising on the renunciation of inheritance and reviewing applicable deadlines.

  • Obtaining a certificate of inheritance and other documents evidencing succession rights.

  • Securing certificates of next of kin and relevant court or administrative records.

  • Identifying inherited real estate, registered property rights, and other estate assets.

  • Assessing potential estate liabilities and obligations.

  • Coordinating inheritance tax filings and related compliance requirements.

  • Registering inherited property with the competent cadastral office or other applicable land registration authority.

  • Advising on wills, succession planning, and inheritance agreements, subject to the applicable statutory and transitional rules.

  • Representing clients in disputes among co-heirs and matters involving the division of inherited assets.

Our objective is to provide clients with a complete understanding of their position and a practical strategy for administering Greek estate matters from abroad.

Frequently Asked Questions

  • The first step is to determine your inheritance rights, identify the assets and liabilities of the estate and establish whether a will exists. Depending on the circumstances, additional certificates, tax filings and notarial or registration procedures may be required before inherited assets can be transferred or registered in your name.

  • Not necessarily. In many cases, heirs living abroad can authorize a lawyer or another appropriate representative in Greece through a properly drafted Power of Attorney. Whether your physical presence is required depends on the specific circumstances and procedures involved.

  • A legal investigation can be carried out through the competent authorities and records to determine whether a will has been published or whether other succession documentation exists. We can conduct the necessary searches and advise you on the next steps.

  • Where no valid will governs the succession, inheritance rights are determined under the applicable rules of intestate succession. The identity and shares of the heirs depend on the family circumstances and the law applicable to the succession.

  • Greek law provides for the renunciation of an inheritance within specific legal time limits. The applicable deadline and procedure should be reviewed promptly, particularly where the heir or the deceased resides or resided abroad. Early legal advice is important because inheritance matters may involve assets as well as liabilities.

  • As part of an inheritance matter, we can investigate available property records and registrations and coordinate the collection of documentation required to establish the deceased’s property rights and the assets forming part of the estate.

  • Co-heirs may acquire rights in the same property. Depending on their objectives, they may retain the property jointly, arrange a division where legally possible, transfer their interests or sell the property. We advise on the available legal options and can assist with negotiations and related property procedures.

  • In many cases, yes. We can coordinate the legal and administrative process in Greece, including the collection of certificates, investigation of estate assets, inheritance documentation, coordination with the notary and accountant, inheritance tax matters and registration of inherited property, subject to the requirements of each individual case.
